Amos & Kapral, LLP Wins Case in North Carolina Court of Appeals04-Jan-2012

The North Carolina Court of Appeals very recently decided an appeal in favor of The Law Offices of Amos & Kapral, LLP and their clients. The decision, handed down on December 20, 2011, addressed an important issue in the area of Worker's Compensation law in North Carolina. North Carolina's general rule is that when an employer and employee are subject to the Act, the rights and remedies granted to the employee under the Act exclude all other rights and remedies against the employer that might otherwise be available to the employee outside of the Act. North Carolina has carved out two exceptions to that general rule of exclusivity, however, and this recent North Carolina Court of Appeals case clarifies when either of those two exceptions would apply, particularly in the public school context. The ruling is a significant development in North Carolina Worker's Compensation law. Read the full case: Joan F. Trivette and Terry Trivette, Husband and Wife, Plaintiffs v.
