Amos & Kapral, LLP Wins Case in North Carolina Court of Appeals04-Jan-2012

The North Carolina Court of Appeals very recently decided an appeal in favor of The Law Offices of Amos & Kapral, LLP and their clients. The decision, handed down on December 20, 2011, addressed an important issue in the area of Worker's Compensation law in North Carolina. North Carolina's general rule is that when an employer and employee are subject to the Act, the rights and remedies granted to the employee under the Act exclude all other rights and remedies against the employer that might otherwise be available to the employee outside of the Act. North Carolina has carved out two exceptions to that general rule of exclusivity, however, and this recent North Carolina Court of Appeals case clarifies when either of those two exceptions would apply, particularly in the public school context. Bayer May Have Pitched Yaz Birth-Control Pill for Unapproved Use29-Nov-2011

FDA Says Yaz Birth Control Increases Risk of Blood Clots27-Oct-2011

The Associated Press reports the FDA's new finding that "on average, women taking Yaz had significantly higher rates of blood clots than women taking older birth control drugs." Amos   T. Dean Amos, one of the firm’s founding members and partners, was born in Chapel Hill, North Carolina. Mr. Amos is a 1983 graduate of the University of North Carolina at Chapel Hill where he received a B.S. degree in business administration. He graduated from Wake Forest University School of Law in 1987. He is a member of the American Bar Association, North Carolina Bar Association, and Catawba County Bar Association and is admitted to practice in the United States District Court, Western, Middle and Eastern districts of North Carolina. He is a past board member of the Catawba County Science Center and past president of the Catawba County Bar Association. Mr. Amos is married and has three children.

Stephen M. Kapral, Jr., one of the firm’s founding members and partners, was born in Williamsburg, Virginia. Mr. Kapral has been awarded the “AV” or “preeminent” rating by the prestigious Martindale Hubbell legal rating publication. Mr. Kapral is a cum laude graduate of Lehigh University and of the University of Miami Law School. Mr. Kapral is a member of the North Carolina and Florida bars as well as the United States District Court (Southern and Middle Districts of Florida). Previously, Mr. Kapral served as a past summer intern for the U.S. District Court for the Eastern District of Virginia.

Prior to relocating to western North Carolina from Florida with his wife, Gae and their two children, Mr. Kapral was a partner and shareholder in the boutique south Florida firm of Zappitell & Kapral, P.A.. Throughout his distinguished legal career in Florida, Mr. Kapral has handled numerous catastrophic injury cases in all areas of personal injury including nursing home abuse, wrongful death, medical malpractice and automobile and trucking accidents. Mr. Kapral’s legal track record is outstanding with many significant high dollar verdicts and settlements achieved. Mr. Kapral is proud to have been involved as a past scoring judge at the Association of Trial Lawyers of America National Student Trial Advocacy Competition. He is a current member of the North Carolina Bar Association, American Bar Association, North Carolina Advocates for Justice and a board member for the Greystone IV Property Association. Mr. Kapral continues to concentrate his practice on providing quality representation to clients in personal injury matters, wrongful death, nursing home cases, and property and fire loss claims.

  Aaron H. Wallace is an Associate Attorney at The Law Offices of Amos & Kapral, LLP. He was born in Hickory, NC and grew up in the community, attending Fred T. Foard High School. Prior to becoming an attorney, his background included management, marketing, communications, and published writing. He is a graduate of The University of North Carolina at Chapel Hill, where he double-majored and was on the Dean's List. He received a Bachelor of Arts degree in both Communication Studies and English.

Mr. Wallace earned his Juris Doctor degree from the Wake Forest University School of Law and is a licensed member of the North Carolina State Bar. While in law school, he clerked for a North Carolina District Court judge. His practice areas include fire and casualty loss, business and corporate law, contract drafting, personal injury, premises liability, and traffic violations, among others. He is a current member of the North Carolina Bar Association.

In addition to his regular practice, Mr. Wallace also volunteers his time with Legal Aid of North Carolina, Young People of Integrity, and the Catawba County Champions of Education.
